2 restaurants on IC3?

I was on the IC3 in the direction of Basel. I entered the restaurant downstairs of the train and bought a drink. The restaurant was full so I went upstairs. Then I found out there is another restaurant upstairs. So I took a seat in the restaurant. However, the staff upstairs told me that if I bought a drink downstairs I cannot sit upstairs in the restaurant, only downstairs, and he asked me to leave. Is this normal?

It could be normal if all tables upstairs were reserved for people who wanted to eat. I suggest to open a claim here:

The reason is a legal one.

If you purchase something downstairs for take away, the VAT is lower than in the restaurant itself. Therefore, people with take away goods cannot use the restaurant facilities otherwise the restaurant owner has to apply the normal VAT.

This is the same everywhere in our country, whether at Migros Restaurant, Mc Donalds, or in a coffee shop.

And yes, the table upstairs are usually kept free for people wishing to dine.

RolandP I think this is not the case. The two restaurants have the same menu and I paid the same price for the drink.

Prices are always the same, but you can see on the receipt if you pay the low or the normal VAT rate. With the low rate, the restaurant earns a little more.
